Upon perusal of the impugned order dated 08.11.2017, it appears that the petitioner was directed to be released on bail with a condition that in case he commits same and similar offence again, his bail would be cancelled. On account of the petitioner being implicated in another same and similar type of occurrence, his bail bond was cancelled.

The learned counsel for the petitioner submits that in the present case the allegation is with regard to recovery of five litres of foreign liquor from a bag kept on the road for which the petitioner has got nothing to do. It is further submitted that the petitioner has been granted bail in the other case in which he was implicated, hence he should be granted bail in the present case.

No.61894 of 2017 (2) dt.21-12-2017 2/2 In the facts and circumstances of the present case, I direct the petitioner above named to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-IInd-cum-Special Judge, Excise, Lakhisarai in connection with Lakhisarai P.S. Case No. 576 of 2016.
