ANJANA MISHRA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

So far as petitioner No. 1 is concerned, he is father of petitioner No.2 and there is no specific allegation against him. Accordingly, let the petitioner No. 1 Talkeshwar Yadav, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand)

Patna High Court Cr.Misc. No.53407 of 2015 (7) dt.04-05-2016 P2/2 with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 324 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. So far as the petitioner No. 2 is concerned, after considering all the facts and circumstances and after hearing learned counsel appearing on behalf of both sides and also after perusal of the case diary, I am satisfied that a prima facie case is made out against the petitioner.

Accordingly, the prayer of the petitioner No. 2 Sanjay Kumar, for grant of anticipatory bail stands rejected in connection with Bodh Gaya P.S. Case No. 324 of 2015.
