This is an appeal under section 14A (2) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against the refusal of prayer for bail vide order dated 29.09.2021, passed by learned 1st Additional Sessions Judgecum- Special Judge, SC & ST (POA) Act, Sitamarhi, in connection with Sonbarsa P.S. Case No.266/2020, registered for the offence punishable u/s 147, 148, 149, 342, 323, 307, 302, 324 of the IPC and sections 3(2)(v) of SC/ST (POA) Act. Earlier, the prayer for bail of this appellant was rejected vide order dated 25.04.2022 passed in Cr. Appeal (SJ) No.4574 of 2021 by this Court with a liberty to renew his prayer for bail after framing of charge.
Patna High Court CR. APP (SJ) No.2567 of 2022(3) dt.21-09-2022 2/2 The appellant has now filed this appeal for bail. It is submitted by learned counsel for the appellant that charge has been framed against the appellant on 10.06.2022. This fact is also supported by Annexure-3 to this appeal. Appellant is in custody since 13.08.2021.
Considering the submissions made, the above named appellant is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, SC and ST (POA) Act, Sitamarhi, in connection with Sonbarsa P.S. Case No.266 of 2020.
The impugned order is accordingly set aside and the appeal is allowed.
