2. The petitioner seeks regular bail in connection with Giriyak (Pawapuri) P.S. Case No. 217 of 2026 registered for the offence under Section(s) 316(2), 318(4), 319(2), 336(3), 338, 339, 340(2) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 66 and 66(D) of the IT Act.

3. As per the prosecution case, the allegation against the petitioner is that, with the assistance of the other co-accused, he hired a scholar to impersonate him and appear in the NEET examination on his behalf.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 05.05.2026 and has no criminal

It is further submitted that the petitioner is neither the solver nor involved in the offence of procuring or facilitating the leakage of the NEET examination question papers. It is further submitted that the petitioner is an NEET aspirant who is alleged to have attempted to arrange for a solver to appear in the examination on his behalf; however, the petitioner ultimately appeared in the examination himself.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances and the fact that the petitioner is not involved in any such offences as alleged, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Giriyak (Pawapuri) P.S. Case No. 217 of 2026.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case
