Petitioner claims pension, gratuity, leave encashment, group insurance and arrear of salary from the month of June 2010 to 9th September, 2011, which, according to him, has been withheld for no fault on part of the petitioner.

Admittedly, the Petitioner's services have been regularized from the first day of his appointment as has been noticed in Annexure-7 by a co-ordinate Bench of this Court. However, what consequential relief the petitioner would be entitled has to be decided

Patna High Court CWJC No.1410 of 2016 dt.19-05-2016 2/2 by the University. It is contended that the matter is being kept pending and the petitioner is made to suffer.

No counter affidavit has been filed though a copy of the writ petition was served upon the university on 05.11. 2015. Accordingly, this writ application is being disposed of with a liberty to the petitioner to approach the Vice Chancellor of the university by filing a proper representation setting out his claim. Thereafter, let the Vice Chancellor take a decision in accordance with law on his representation. If the petitioner is found entitled for the consequential relief and post retiral benefit is also found payable to him then a decision should be taken and necessary payment should be made within a period of two months and admissible amount, if any, should be paid within the further period of two months.
