JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302,201 and 120B of the Indian Penal Code.

The accusation is of killing the daughter of the informant who was pursuing her studies since 12 years at the house of maternal uncle but her dead body was recovered from the railway track.

It is submitted by the learned counsel for the petitioner that the petitioner happens to be the maternal sister of the victim and only on suspicion the accusation has been levelled. On the date of recovery of the dead body, UD case was registered but on the ninth day of the recovery of the dead body, the present FIR has

Patna High Court Cr.Misc. No.53156 of 2015 (2) dt.23-11-2015 2/2 been registered. It is further submitted that co accused Nanki Devi has been granted anticipatory bail vide Cr. Misc. No. 44751 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Naugachiya in connection with Bihpur (Jhandapur) P.S. Case No.201 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
