ANJANA MISHRA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 467/468/471/406/409/420/120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is an Assistant Engineer who was responsible for the implementation of the schemes with regard to MNREGA which was to be conducted by the District Rural and Development Agency, Vaishali. The allegation against the petitioner is that he had misused the funds of the aforementioned schemes and the records were found to have been tampered with and there was overwriting in the facts and figures of the said records.

Patna High Court Cr.Misc. No.38083 of 2016 (2) dt.06-10-2016 P2/2 Learned counsel for the petitioner, however, submits that the petitioner has no role to play in such overwriting as the records are never maintained by him and he is only involved in the project work and not otherwise.

Considering the nature of allegations made against the petitioner and also because the enquiry was conducted in the year 2015 with regard to the scheme of the year 2008, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 263/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
