JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in Mokama P.S.Case No.71 of 2015 registered for the offences under Sections 420, 406, 467, 468 and 120(B) of I.P.C.
The allegation of the informant/complainant, Mansoor Alam is that in the year 2010 his villager Raghunath Mahto met him introducing himself as a Cashier in a company, namely, M/s Common Weal Beverage Company Ltd.and told him that the Company is doing business of depositing the money of the public and the Company is doing well in returning maturity amount to policy holder. Thereafter the informant connected with the Company after receiving Identity Card and began business of

No.38906 of 2016 (2) dt.05-10-2016 2/3 the Company and got deposited a sum of Rs.80/- lacs in the said Company from the policy holder who were his kith and keen and in course of doing business co-accused, Kasinath Mahto, who used to accompany the petitioner was also one of the deputy Manager of the Company. But latter on the Company was closed of which Raj Kumar Mahto and Ramashish Mahto were Manager and Deputy Manager and this petitioner was Holder Member of Deputy Cashier.
Learned counsel for the petitioner submits that, in fact, petitioner is the Railway employee and he never indulged in business of Common Weal Beverages Company and he has been falsely implicated in this case with ulterior motive. Moreover, Raghunath Mahto who is said to be cashier and asked the complainant to do the work of the Company and one co-accused Kashinath Mahto one of the Holder Members of the Company have already been granted anticipatory bail vide Cr.Misc.No.33804 of 2016 on 20.08.2016.
Having considered the facts and the circumstances of the case, let the petitioner, above name, in the event of his arrest or surrender before the court below within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the
