The petitioners seek bail in anticipation of their arrest in connection with Supaul Mahila P.S. Case No. 38 of 2020, instituted for the offences under Sections 341, 323,

Patna High Court CR. MISC. No.41153 of 2020(2) dt.22-06-2021 2/3 354, 307, 504, 506 and 379/34 of the Indian Penal Code. The learned counsel for the petitioners has pointed out that an occurrence took place at the time of Iftar, when the petitioner Nos. 2 and 3 are said to have assaulted the informant by means of hockey stick and knife. The other accused persons are not specifically alleged to have done anything. He has further drawn the attention of this Court to the injury report of the informant, which reflects that she has received a simple injury, which cannot be attributed to the transaction which has been reported in the F.I.R. It has further been submitted that the petitioners are the agnates of the informant and there appear to be a dispute between them and as a result of such dispute, the petitioners have been falsely implicated in this case.

Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.41153 of 2020(2) dt.22-06-2021 3/3 each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Supaul, in connection with Supaul Mahila P.S. Case No. 38 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
