The petitioner seeks bail in anticipation of his arrest in connection with Maigara P. S. Case No. 19 of 2018 dated 12.07.2018 instituted for the offences under Sections 341, 323, 448, 354, 307, 504, 427 and 379 of the Indian Penal Code.
The petitioner is the younger brother of the informant who is alleged to have assaulted the informant and his wife by means of a lathi over a dispute of partition in the family property.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.61548 of 2018(3) dt.25-01-2019 2/2 that because of the aforesaid dispute, he has been falsely implicated in this case. The injuries suffered by the informant and his wife are stated to be simple in nature and caused by hard and blunt substance.
Considering the relationship between the petitioner and the informant and other attendant facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Shri Gorakh Nath Dubey, JM, 1st Class, Sherghati, Gaya in connection with Maigara P. S. Case No. 19 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U
