The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 406, 506 and 354/34 of the Indian Penal Code.
Prosecution case in nutshell is that earlier the husband of the informant was killed by the brother of the petitioner and Riga P.S. Case No. 139 of 2020 was lodged. Thereafter, the petitioner and other accused persons came with arms and forced her to vacate her house and threatened not to give her Rs. 15 lacks and they also threatened that she will be killed along with her other family members, such as, they have killed her husband.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.52791 of 2021(3) dt.22-06-2022 2/2 that the petitioner has falsely been implicated in this case. He further submits that there is no cheat of paper available with the informant as a document in respect of giving the money of Rs.15 lacks to the petitioner by the informant. He further submits that the informant has personal grudge with the petitioner and to make pressure for not vacating the rented house which given by the petitioner to the informant, the frivolous allegation has been levelled against the petitioner. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Sitamarhi P.S. Case No. 436 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
