Petitioner is accused in different sections of the Arms Act and under section 17 of the C.L.A. Act. Petitioner was apprehended and from his possession one musket, one country made pistol and one Nokia mobile and a motorcycle were recovered. Petitioner is alleged to be a member of Maoist gang. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and no arms was recovered. In fact the police planted arms and shows false recovery. One musket and one country made pistol without cartridge were recovered from the possession of the petitioner. The petitioner has remained in jail for more than

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hajipur at Vaishali in Hajipur Sadar P.S.Case No. 107 of 2014.
