This application is for grant of regular bail in connection with Gaunaha P.S.Case No.61 of 2018 for the offences under Sections 25(1-a) 25(1-b)a, 25 (1aa), 26, 29, 35 of the Arms Act.
Allegation as per FIR is for running a factory for manufacturing the arms.
Submission of the learned counsel for the petitioner is that all the articles ie.. semi manufactured pistol and cartridges were recovered from the house of Shambhu Sahrma and nothing has been recovered from the possession of the petitioner. It is also submitted that the petitioner is the son of Shambhu Sharma and that is why he has been implicated in this case and the house is joint house and nothing has been
Patna High Court Cr.Misc. No.63849 of 2018(3) dt.07-12-2018 2/2 recovered from the house which is in possession of the petitioner, which will appear from the seizure list and moreover the petitioner is in custody for six months.
Heard learned A.P.P. also, who has opposed the prayer for bail stating that there is recovery from the house and the petitioner was also present there.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner , however, the learned trial court is directed to expedite the trial .
With the aforesaid observation, this application is dismissed.
