2. Petitioner is in custody in a case registered for the offences punishable under Sections 103(1), 238, 3(5) of BNS.

3. As per the prosecution case, it is alleged that the present petitioner along with other co-accused person has killed the husband of the informant and has thrown the body of the deceased in the maize field.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that petitioner is a lady and is not named in the FIR although name of the petitioner has been transpired on the basis of confessional statement of the co-accused person, namely, Md. Margoob Ahmad. He next submits that the coaccused person, namely, Margoob Ahmad has already granted

Patna High Court CR. MISC. No.41686 of 2025(3) dt.10-09-2025 2/2 bail by a co-ordinate Bench of this Court vide order dated 02.09.2025 passed in Cr. Misc. No.38188 of 2025. He next submits that petitioner is a lady and is in custody since 06.03.2025 and has got no criminal antecedent as stated in para3 of the bail petition.

5. Learned APP for the State as well as learned counsel for the informant oppose the prayer for bail of the petitioner.

6. Considering the facts and circumstances of the case as well as the submissions made by learned counsel for the petitioner and also the fact that no circumstantial evidence and eye witness has been found against the petitioner and similarly situated co-accused person has already granted bail by a coordinate Bench of this Court vide order dated 02.09.2025 passed in Cr. Misc. No.38188 of 2025, let the above named petitioner be released on bail, on her furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Amour P.S.
