The petitioners apprehend their arrest in Nagarnausa P.S. Case No. 91 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
Keshav Ram, the informant named the petitioners along with other accused persons and alleged that they assaulted the informant and others and also took away different articles from his house.
Learned counsel for the petitioners submits that Keshav Ram is the cousin of Kishore Ram. Some altercation took place due to some family dispute. Petitioner No. 1 and 2 are the sons-in-
Patna High Court Cr.Misc. No.48866 of 2016 (2) dt.16-12-2016 2/2 law of Kishore Ram and Guriya Devi is the wife of Rajesh Kumar. No allegation of assault is made against the petitioners. Considering the facts aforesaid and the fact that the petitioners are, of course, named in the FIR but no specific allegation is made against the petitioners, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa in Nagarnausa P.S. Case No. 91 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
