ANJANA MISHRA ORAL ORDER 10-11-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 28.10.2016 in connection with Muffasil P.S. Case No. 403 of 2016 for the offence registered under Sections 394 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the first information report but his name has surfaced on the basis of the confessional statement of coaccused, Jakirullah made before the police, which has no evidentiary value. Moreover, the petitioner has not yet been placed on Test Identification Parade.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the

No.51996 of 2017 (2) dt.10-11-2017 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 9th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil P.S. Case No. 403 of 2016.
