The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 392, 326, 379, 452, 364A of the Indian Penal Code and 27 of the Arms Act. The prosecution case in short is that the accused persons fired as a result of which, the informant sustained fire-arms injury. It is also alleged that Rs. 45,000/- and ornaments were looted away.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-01-2018. Charge sheet has already been submitted. The petitioner has been falsely

Patna High Court CR. MISC. No.42463 of 2019(2) dt.11-07-2019 2/2 implicated in the present case. The case has not been committed to the court of Sessions. Hence, there is no chance of conclusion of the case in near future. The petitioner is ready to cooperate with the trial. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 14-05-2019 passed in Cr. Misc. No. 14101 of 2019. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Jamui in connection with Chandradeep P.S.
