Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State video conferencing. The petitioners apprehend their arrest in connection with L.N.M.U. P.S. Case No. 46 of 2021 registered for the offences punishable under Sections 302/31 of the Indian Penal Code.
On the instruction of the Parvikar, learned counsel for
Patna High Court CR. MISC. No.53763 of 2021(2) dt.15-02-2022 2/2 the petitioners submits that final form, exonerating the petitioners, has been submitted by the police and, therefore, the petition has become infructuous.
In that view of the matter, the petitioners are permitted to withdraw the present anticipatory bail application with liberty to file a fresh anticipatory bail application, in case, the court below differs with the final form and takes cognizance against the petitioners.
Considering the facts and circumstances, the present anticipatory bail application stands disposed of. (Sandeep Kumar, J) Saif/- U T
