This is an application for grant of anticipatory bail in Sono P.S. Case No. 98 of 2019, disclosing offence under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
In view of the Full Bench decision rendered in the case of Ram Vinay Yadav vs. The State of Bihar, reported in 2019(2) PLJR 1089, this application cannot be maintained and is accordingly dismissed.
However, keeping in mind the submission made on behalf of the petitioner that his implication is only on the basis that he is the owner of a Pick-up Van from where the recovery of illicit liquor has been made, he has been implicated. He
Patna High Court CR. MISC. No.43573 of 2019(2) dt.16-07-2019 2/2 submits that there is no allegation in the First Information Report that it was within the petitioner's knowledge that vehicle was being used for some illegal purpose.
Considering the peculiar facts and circumstances of the case, if the petitioner surrenders before the Court below within four weeks from today, his application for regular bail shall be considered and disposed of on the same day. (Chakradhari Sharan Singh, J) arun/- U
