The petitioner apprehends his arrest in Imamganj P.S. Case No. 100 of 2015 under Section 302/34 of the Indian Penal Code.
The informant alleged that her son, Ramjee Singh, was operating his mill, Shambu Singh came there and took him on the pretext of some work, but, her son did not return. The informant, further, alleged that one week ago Chitranjan Singh and others had threatened her son.
It is submitted that except the suspicion, no material is against the petitioner, Shambhu Singh, is said to have taken the son of the informant. The petitioner was not last seen and other similarly situated co-accused, i.e., Chitranjan Singh, Navin Singh, Pravin Singh, Ashok Singh and Pankaj Singh have already been enlarged on anticipatory bail vide order, passed in Cr. Misc. No. 45059 of 20115 by a coordinate Bench of this Court. On the face of it, it appears that case of the petitioner stands on similar footing to that of other co-accused persons.
Considering the facts and circumstances, the
Patna High Court Cr.Misc. No.27932 of 2016 (2) dt.02-09-2016 petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with the Imamganj P.S. Case No. 100 of 2015 to the satisfaction of Sri Abhay Srivastav, Judicial Magistrate, 1st Class, Sherghati, Gaya, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
