Petitioner, already in custody, seeks bail in connection with Fatehpur P.S. Case No.231 of 2016, registered under Sections 457/380 of the Indian Penal Code.

Allegation in brief is that unknown miscreants committed theft of cash of Rs.12,09,330/- after breaking open the ATM machine.

Learned counsel for the petitioner submits that the FIR is against unknown and except the disclosure of name of the petitioner by other co-accused, there is no other material against him. No incriminating material has been recovered from possession of the petitioner, charge-sheet has been submitted in this case and the petitioner is in custody since 08.09.2017.

No.57480 of 2017 (3) dt.17-01-2018 2 /2 Considering the facts and circumstances of the case, petitioner Rohit Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Fatehpur P.S. Case No.231 of 2016.
