JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 447, 307, 436, 332, 333, 353, 379 of the Indian Penal Code. The prosecution case is that in a road accident, the brother of the petitioner was died leading to registration of Rautara P.S. Case No.8 of 2015. Subsequently, the mob blockade the road when co-accused Khubeb Alam ordered to put the vehicle on fire then this petitioner and co-accused Md. Samir @ Fakir brought match box and lit the vehicle on fire.
It is submitted by learned counsel for the petitioners that since the brother of the petitioner was died in road accident, he was taking care of the dead body and rest family members. The accusation is against the mob and accusation of litting fire is not
Patna High Court Cr.Misc. No.54514 of 2015 (2) dt.02-12-2015 2/2 specific against the petitioner. Moreover, similarly situated coaccused Samir @ Fakir has been granted anticipatory bail by a coordinate Bench of this Court vide Criminal Miscellaneous No. 32410 of 2015 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Rautara P.S. Case No.9 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
