JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code. The prosecution case is that accused persons variously armed came at the disputed land and on protest being made co-accused Sita Ram Mandal ordered for assault, whereupon co-accused Bindeshwari Mandal caused injury with farsa on the head of the informant and when son-in-law and mother of the informant came to rescue then Ranjan Mandal caused injury on the head of son-in-law and thereafter all the accused persons assaulted the informant, his mother and sonin-law. Patna High Court Cr.Misc. No.55729 of 2015 (2) dt.09-12-2015 2/2 petitioners that accusation of assault is not specific against the petitioners. Moreover the accusation has been levelled in the background of earlier proceedings under Sections 144 and 107 Cr.P.C and the wife of Bindeshwari Mandal filed Complaint Case No. 932 of 2015 against the present informant. On conclusion of the investigation, the petitioners were not sent up for trial but differing with the final form, cognizance has been taken on 01.08.2015.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Raniganj P.S. Case No. 78 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
