The petitioner seeks bail in connection with Mehsi P.S. Case No. 75 of 2013 registered under Section 379 of the Indian Penal Code.
63 K.V.A. transformer is said to have been stolen by some unknown miscreants thereby causing loss of Rs. 63,121/- to the electricity department.
It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. There is nothing in the record and in the case
Patna High Court Cr.Misc. No.54227 of 2017 (2) dt.13-12-2017 2/2 diary indicating the complicity of the petitioner in the occurrence barring confessional statement of the co-accused. Though, two criminal cases are pending against him but he is on bail in both the said cases. The petitioner has been languishing in custody since 17.08.2017. Similarly situated co-accused namely, Birendra Mahto has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 26.05.2014 passed in Cr. Misc. no. 15955 of 2014.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Sadar, Motihari, East Champaran in connection with Mehsi P.S.
