The petitioner apprehends his arrest in Madhepura P.S. Case No. 714 of 2019, registered for the offences punishable under Section 364 of the Indian Penal Code. Later on, sections 302, 201 and 120(B) of the Indian Penal Code were also added.

As per the prosecution case, this petitioner with the help of other persons kidnapped the victim boy Ashish Kumar Ray. Later on, the dead body of the victim body was recovered from a Bahiyar.

It is submitted that petitioner has been made accused in this case only on suspicion. As a matter of fact, minor sister of the petitioner was raped by the maternal nephew of informant and his associates and the informant and others in order to save

However, counsel for the Sate vehemently opposed the prayer for bail and submitted that there is specific and direct allegation against this petitioner that he along with others kidnapped and killed the maternal nephew of informant. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected.
