The petitioner apprehends his arrest in a case registered for the offence punishable u/s 420, 406 of the IPC. 3.

As per the prosecution case, petitioner misappropriated Rs.1,06,000/- from Swatantra Microfin Pvt. Ltd., which he had collected from various women group.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. Petitioner has no criminal antecedent. He submits that from the perusal of the FIR, it is clear that Rs.21,300/- has been deposited by the petitioner and only Rs.84,700/- is pending. Petitioner is ready to deposit the amount of Rs.84,700/- in the said company within a

Patna High Court CR. MISC. No.45977 of 2024(2) dt.24-07-2024 2/2 period of two weeks from today.

Accordingly, petitioner is directed to deposit Rs.84,700/- in the said company within a period of two weeks from today. 6.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on provisional bail for a period of six weeks from today, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Motipur P.S. Case No.256 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. 7.

The provisional bail of the petitioner shall be confirmed by the learned court below itself on showing the receipt of deposit of aforesaid amount in the said company within the stipulated period.
