JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that the victim has specifically stated in her statement recorded under Section 164 Cr.P.C that she solemnized her marriage with the petitioner and she was never kidnapped by the petitioner. No doubt, the learned court below rejected the prayer for bail of the petitioner on relying upon school certificate of the victim, but Medical Board found the victim between 18 to 19 years and moreover the victim has no grievance against the petitioner.

Admittedly, after solemnization of her marriage, she was leading her married life with the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc.
