The petitioner is in custody since 31.07.2017 in connection with Kotwali P.S. Case No. 455 of 2017 for the offence registered under Sections 461, 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that he was not named in the first information report but on the basis of the confessional statement made before the police by one Sumit Kumar Sah, in whose house the petitioner was a tenant, the name of the petitioner has surfaced in connection with the present case. It is further submitted that there is no recovery from the possession of the petitioner and the petitioner has not been placed on T.I.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P.S. Case No. 455 of 2017.
