JUSTICE JYOTI SARAN ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecution for the State.

The petitioner apprehends his arrest in connection with Rajiv Nagar P.S. Case No. 236 of 2014/G.R.No.8200 of 2014 for the offences punishable under Sections 420, 406 and 506 of Indian Penal Code.

Mr. Ashok Kumar Choudhary, learned counsel for the petitioner with reference to the F.I.R. placed at Anneuxre-1 submits that although the informant has charged the petitioner of misappropriating Rs. 1 lac 10 thousand taken by him for sale of a car but the entire allegation is fictitious and based on no documents. He submits that except that a sum of Rs. 10,000/- was given by the informant by cheque in respect of payment of repair of car, the rest of the amount is concocted. It is admitted

Having heard learned counsel for the parties and considering the submissions of learned counsel, let the petitioner namely, Md. Safuddin @ Safudin Ahmad in the event of their arrest/surrender within four weeks from today, be released on bail upon furnishing bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Rajiv Nagar P.S. Case No. 236 of 2014/G.R. No. 8200 of 2014 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) Bibhash/- U T
