Mr. Brajendra Nath Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 19-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 413, 414, 379 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that on secret information, the Garage of Pappu Jee was raided from where five accused were apprehended along with four stolen motorcycle and accused 'Vishal Kumar' disclosed the name of the petitioner as their associate.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that apart from confessional statement nothing

Patna High Court CR. MISC. No.52466 of 2021(2) dt.19-09-2022 2/2 has come during the course of investigation which could even remotely connect the petitioner with the offence. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chakiya P.S. Case No. 157 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

One of the bailors shall be the father of the petitioner Kishore Paswan, further if the police after investigation submits charge-sheet against the petitioner then the present anticipatory bail order shall lose its effect.
