ANJANA MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.07.2017 in connection with Motihari Town P.S. Case No.468 of 2017, corresponding to G.R. No.4098/17 registered for the offence under Sections 379 and 411/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the entire allegation against the petitioner is false and has been occasioned because there was a scuffle between the petitioner and the informant with regard to engaging a rickshaw puller and the mobile so recovered is of the petitioner himself. He further submits that the informant himself handed over the bag, stating that the petitioner had snatched it, which is wholly false

Considering the period of custody and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Town P.S. Case No.468 of 2017, corresponding to G.R. No.4098/17.
