JUSTICE S. KUMAR ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Mainatarn (Mainatard) P.S. Case No. 93 of 2017 registered for the offence punishable under Sections 323, 363, 366(A), 494/34 of the Indian Penal Code.

The informant is the father of the victim and has alleged in the FIR of kidnapping of his daughter by the informant with intent to marry her. The girl has been recovered and she was subjected to medical examination in which her age has been determined between 17-19 years and statement has also been recorded under Section 164 of the Cr.P.C. in which she had stated that on account of torture of father she had fled away to Jalandhar

Patna High Court Cr.Misc. No.55758 of 2017 (3) dt.11-01-2018 2/2 to her sister's house. Petitioner has no criminal antecedent and he is in custody since 13.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bettiah (West Champaran), in connection with Mainatarn (Mainatard) P.S. Case No. 93 of 2017.
