====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 188, 420 of the Indian Penal Code and Sections 30, 30(a) and 38 of Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 2212 liters of foreign liquor was recovered from a truck. It is contended that the petitioner is the Driver of the Truck and he has no knowledge as to how and where illicit liquor was loaded on the truck. Nothing has been recovered from his conscious possession. It is further contended that similarly situated co-accused Bajrangi Singh has already been granted bail by a coordinate Bench of this Court vide order dated 08.08.2018 passed in Cr.Misc. No.48555 of 2018. It is also contended that the petitioner has no criminal antecedent. It is

Patna High Court Cr.Misc. No.55224 of 2018(3) dt.06-10-2018 2/2 urged that the petitioner is in custody since 24.05.2018. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge, Saran at Chapra in connection with Manjhi P.S. Case No.111 of 2018 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. Further with a condition that one of the bailors must be belonging to the State of Bihar.
