The grievance of the petitioners in the present writ application is non-consideration of the case for grant of promotion and benefit of such promotion from the date juniors to the petitioners have been granted.

Learned counsel for the State submits that the petitioners have been granted benefit of graduate trained scale pursuant to Annexure-4. However, he has not been able to

Patna High Court CWJC No.20195 of 2011(8) dt.22-06-2018 2/2 dispute the fact that juniors to the petitioners have been granted such benefit from a date anterior to grant of promotion to the petitioners.

In view of the above, the writ petition is disposed of with direction to the respondents to examine the claim of the petitioners and if it is found that juniors to the petitioners have been granted benefit of graduate trained scale from earlier date, similar benefit should be extended to the petitioners from the date juniors to the petitioners have been granted such benefit. The entire exercise in this regard must be taken by the respondents within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
