The petitioners have preferred this application for grant of regular bail in a case registered under sections 302,147, 148 and 149 of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, the eight named accused persons including the two petitioners herein as also 4-5 unknown are said to have came variously armed and as a result of firing by them the mother of the informant was shot and she died on the spot.
It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in
Patna High Court CR. MISC. No.52569 of 2021(2) dt.25-02-2022 2/2 the case. The allegations are general and omnibus in nature. They are in custody since 26.7.2021 and have no criminal antecedent. Chargesheet has been submitted in the case. A number of coaccused including Shatrudhan Rai, Amar Nath Rai, Chandra Bhushan Rai, Sunil Rai and others have been granted bail, copies of which are on record as annexures to the petition Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, the general and omnibus allegation against the petitioners, chargesheet having been submitted in the case and grant of bail to the above named accused, the Court directs the two petitioners to be enlarged on bail in connection with Patory P.S. Case no. 51 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-2, Samastipur.
