1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Nawanagar (Basudeva O.P.) P.S. Case no.348 of 2021 registered under sections 307, 323, 324, 341, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, allegation against the petitioner is of having given a chhura blow in the stomach of the informant's husband leading to serious injuries.

4. Learned counsel for the petitioner submits that the earlier application for bail of the petitioner was rejected vide order dated 19.12.2022 (Annexure-1) passed in Cr. Misc. no.11921 of 2022. The petitioner is in custody since 15.9.2021 and undertakes to cooperate in the trial.

5. The prayer for bail is opposed by learned A.P.P. for

6. A report was called for from the learned trial Court. As per the report received contained in letter dated 1.08.2023 from the 4th Additional District and Sessions Judge, Buxar, charge has been framed on 21.1.2023 and further on the last three dates of hearing no witness has been produced on behalf of the prosecution.

Having heard learned counsel for the parties and taking into consideration the submissions made, the contents of the report received from the learned trial Court, charge having been framed, no witness being produced by the prosecution together with the petitioner having remained in custody since 15.9.2021, the Court directs the petitioner to be enlarged on bail in connection with S. Tr. no. 186 of 2022 (arising out of Nawanagar (Basudeva O.P.) P.S. Case no. 348 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Buxar.
