JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-11-2017 Heard leaned counsel for the petitioner and the leaned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 70 of 2017, registered under Sections 467, 468 and 471/34 of the Indian Penal Code, pending in the court of the S.D.J.M. Munger.

The accusation is that a warrant of arrest was issued against Md. Laltu, son of Md. Sakil, resident of Mirjapur Bardah, P.S. Muffasil, District-Munger in connection with Sessions Trial No. 782 of 2013. In course of execution of the warrant, when Police reached in the village then Md. Sakil, father of the warrantee, disclosed that Md. Laltu has died and the petitioner being the Sarpanch issued Death Certificate to the effect that Md.

Patna High Court Cr.Misc. No.55353 of 2017 (2) dt.28-11-2017 2/2 Laltu has died on 30.10.2006 in a road accident, while Md. Laltu was alive.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
