JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. The petitioner, who is a Branch Manager of Central Cooperative Bank, Areraj, apprehends his arrest in connection with Govindganj P.S. Case No.37 of 2015 for the offence under sections 420, 406, 409 and other allied sections of the Indian Penal Code.
It is alleged by the informant that he got Crop Insurance done in the Bank. The petitioner in league with others inserted the name of another person in place of the informant. It is further alleged that the petitioner and other co-accused withdrew Rs.1,25,610/-.
The petitioner submits that the insurance amount of
Patna High Court Cr.Misc. No.52479 of 2015 (2) dt.10-11-2015 Rs.1,25,610.41 was withdrawn by co-accused Rakesh Pandey on the instruction of higher authorities which he deposited in the court below. The petitioner submits that he is innocent and not involved in the occurrence.
Considering the facts and circumstances of the case, the petitioner Arun Kumar Singh is directed to be released on anticipatory bail, in the event of his arrest/surrender, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sadar, East Champaran at Motihari in Govindganj P.S. Case No.37 of 2015 subject to the conditions that he would cooperate in the trial and would not physically absent himself for two consecutive dates at a stretch save and except for valid reasons.
