30-11-2016 The petitioner apprehending arrest in relation to Araria P.S. Case No. 148 of 2016, instituted under Section 406, 409 and 420 of the Indian Penal Code in respect of alleged defalcation of Rs. 75,00,000/- (Rupees Seventy Five Lacs) of Bihar State Food and Civil Supplies Corporation Limited, filed anticipatory bail application in this Court. He was directed to deposit the entire amount as a condition for grant of indulgence. He has already deposited Rs. 33,00,000/- (Rupees Thirty Three Lacs), but had sought time to deposit the balance Rs. 42,00,000/- (Rupees Forty Two Lacs). He, in the meantime, further deposited Rs. 2,00,000/- (Rupees Two Lacs) as well.
By order dated 31.08.2016, passed in Cr.
Patna High Court Cr.Misc. No.49641 of 2016 (2) dt.30-11-2016 Misc. No. 37945/2016, further time of eight weeks was granted to make the entire payment. It appears, the time was insufficient, as no further payment has been made. Further time is sought for.
As a matter of last indulgence and making it clear that under no circumstances any further indulgence would be granted. The time fixed, as per order passed in Cr. Misc. No. 24655/2016, is extended by eight (8) weeks.
With this modification, this application stands disposed of.
