JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 47, 49, 50 and 53(c) of the Bihar Excise Amendment Act.

Allegation is that from possession of petitioner 40 litres of country made liquor has been recovered.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 40 litres of country made liquor is said to have been recovered from possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with

Patna High Court Cr.Misc. No.45201 of 2016 (2) dt.15-12-2015 2/2 two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Siwaipatti P.S. Case no. 57 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
