JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 17-10-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in Kasim Bazar P.S. Case No. 135 of 2017 registered under Sections 457, 380 and 411 of the Indian Penal Code.

Petitioners are said to have committed theft of belongings of the informant intruding into his house along with other accused persons.

It is submitted by learned counsel for the petitioners that they have been falsely implicated in the case due to animosity. No incriminating article has been recovered from their conscious physical possession rather from Bholu Yadav. There is nothing in the record indicating the complicity of the petitioner in the

Patna High Court Cr.Misc. No.50299 of 2017 (2) dt.17-10-2017 2/2 occurrence barring confessional statement of Bholu Yadav @ Akash Yadav and Rupesh Yadav. Said Bholu Yadav and others have been enlarged on bail by a co-ordinate Bench of this Court vide order dated 20.09.2017 passed in Cr. Misc. No. 42774 of 2017. The petitioners have been languishing in custody since 09.08.2017.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 135 of 2017.
