Petitioners apprehend their arrest in connection with a case registered under Sections 328, 302 and 34 of the Indian Penal Code.

Allegation in brief is that the informant's son had gone to his father-in-laws' village along with his wife and it is alleged that poison was administered by the accused persons there. It is submitted that in fact the informant's son committed suicide by taking Sulfas as he was depressed due to illicit relationship going on in between his wife and his elder brother-in-law (Sarhu) this fact is supported by witness recorded

Having considered the said facts and circumstances, the prayer for anticipatory bail of petitioner no.3, namely, Amar Kishore Ram, brother-in-law (Sarhu) is rejected and prayer for anticipatory bail of petitioner nos.1 and 2 are allowed. Let the petitioner nos.1 and 2, namely, Rajesh Ram @ Rajesh Kumar Ram and Kari Ram be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-Ist, Araria in connection with Bausi P.S. Case No.12 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
