JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel appearing on behalf the petitioner and counsel appearing on behalf of the State. The petitioner is in custody since 26.06.2018 in connection with Complaint Case No. 961 (C) of 2016 for the offence under Section 498 (A) of the Indian Penal Code. Learned counsel for the petitioner submits that although the petitioner was cheated in the process of marriage but notwithstanding the aforesaid fact he is ready to keep his wife with full honour and dignity.
Considering the aforesaid facts that petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.54136 of 2018(2) dt.20-09-2018 2/2 amount each to the satisfaction of learned SDJM, Danapur, Patna in connection with Complaint Case No. 961 (C) of 2016. The Court while releasing the petitioner shall see that the dispute between the petitioner and wife is sorted out by referring to mediation centre. In the event the petitioner resile from his undertaking to keep his wife with full dignity the court below is liberty to cancell the bail bonds.
With the aforesaid the bail application for grant of bail is allowed.
