JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-09-2019 The petitioner apprehends arrest in connection with Manjhagarh P. S. Case No. 192 of 2018 registered under Sections 147,148,149,302,307,324,341 and 504 of the Indian Penal Code.

Allegation against the petitioner is that petitioner along with accused persons assaulted the family members of the informant.

Learned counsel appearing on behalf of the petitioner submits that altogether 14 persons are named in the FIR and there is no allegation of assault upon the petitioner though allegation of assault is upon other co-accused persons and the name of the petitioner has merely been mentioned in the column of accused persons without any overt act. Learned counsel, relying upon Annexure-2 series, submits that other co-accused

No.41280 of 2019(3) dt.20-09-2019 2/2 persons against whom allegation of assault is there, they have been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc. No. 71087 of 2018 and in other cases also. Having regard to the submissions made by the parties and taking into consideration the fact that no overt act has been alleged against the petitioner and other co-accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court, I am inclined to grant anticipatory bail to the petitioner. Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Manjhagarh P.S.Case No. 192 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
