JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 10-08-2016 This application has been filed, in fact, seeking a direction to count the petitioner's pensionable service from the date when his name was empanelled for appointment against Class IV post in the office of the Collector, Bhojpur.

It seems that in the light of an order of this Court dated 21.08.1997, the petitioner was appointed against Class IV post on 04.02.1999. By the said order, the Court had directed to ensure consideration of the petitioner's case for appointment. There was no direction by this Court in the said order dated 21.08.1997 that any period prior to the date of his appointment shall be counted for any purpose whatsoever.

Patna High Court CWJC No.12110 of 2012 dt.10-08-2016 Learned counsel appearing on behalf of the respondent State of Bihar has submitted that the petitioner attained the age of superannuation on 31.05.2012 and all admissible retrial dues have been paid to the petitioner counting his pensionable service from the date of his appointment against Class IV post in the year 1999, till the date he attained the age of superannuation.

Considering the above submission, no further order need be passed in the present proceeding, as sought in the application. This application stands disposed of.
