The appellant has questioned the order dated 07.10.2017 passed by the learned Additional Sessions Judge 1st, Supaul in connection with SC/ST Case No. 110/2017, arising out of Ratanpura P.S. Case No. 23/2016 instituted for the offences under Sections 341, 323, 324, 353, 224, 225, 379 and 504/34 of the Indian Penal Code read with Sections 3(i)(r) of SC/ST (Prevention of Atrocities) Act, whereby his prayer for being released on bail has been rejected.

While the police party had come to arrest the appellant in connection with an excise case, viz. Ratanpura P.S. Case No. 20/2017, the police party and the informant of the case

Patna High Court CR. APP (SJ) No.3121 of 2017 (4) dt.30-11-2017 2/2 were assaulted and abused by taking their caste name. The appellant is in custody since 15.07.2017. Some of the other accused persons of this case have been granted bail by a co-ordinate Bench of this Court.

Regard being had to the nature of accusation against the appellant and the period of custody, this Court deems it appropriate to set aside the order dated 07.10.2017. The appellant is directed to be released on bail on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Court of SC/ST Act, Supaul in connection with SC/ST Case No. 110/2017, arising out of Ratanpura P.S. Case No. 23/2017.
