Case No. 469 of 2024 and accordingly, they are being heard together and disposed of with this common order.

2. Heard learned counsel for the petitioners and learned APP for the State.
3. The petitioners are apprehending their arrest in Rajapakar P.S. Case No. 469 of 2024 registered under Sections 80(2) & 238 of B.N.S.S.
4. Allegedly, the co-accused Rahul Sharma performed his love marriage with Kajal Seth, daughter of the informant and out of their wedlock, a male child was born. It is further alleged that after sometime, the petitioner along with co-accused persons started demanding Rs. One lakh as cash and a motorcycle and on denial, the victim was abused and assaulted and consequently, the daughter of the informant was killed and her dead body got disappeared.
5. It has been submitted on behalf of the petitioners that the petitioners are in-laws of the deceased having no concern with the affairs of the couple. As a matter of fact, the co-accused Rahul Sharma (the husband) and the deceased Kajal Seth solemnized their love marriage and the petitioners have no concern with that love marriage. The independent witness in paragraph-6 of the case diary has stated that Rahul Sharma was already a married person and later on, he developed love with the deceased. The said relation was not acceptable to his family

This witness has categorically stated that after solemnizing his marriage with Kajal Seth, the couple started residing separately, which shows that the deceased and her husband were residing separately from the petitioners. The husband of the deceased is in custody since 20-01-2025.
6. Learned Additional Public Prosecutor opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/ learned Judicial Magistrate-Ist Class/concerned court, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 469 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of BNSS, 2023.
