ANJANA MISHRA ORAL ORDER 16-11-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 15.04.2017 in connection with Bangaon P.S. Case No. 32/2017 registered for the offences punishable under Sections 147/148/149/307/399/402 /353 /332 /333 /188/224/ 225 of the Indian Penal Code and Section 25(1-b) a/25(1-AA) 26/27/35 of the Arms Act.

Learned counsel for the petitioner submits that only allegation against the petitioner is that he was sitting in the house of one Amit Jha along with the other persons who were planning to commit some offence. It is on the basis of secret information that the police raided the place and recovered arms and also arrested the petitioner along with the others. He further submits

Patna High Court Cr.Misc. No.52172 of 2017 (2) dt.16-11-2017 2/2 that other similarly situated persons who were also found at the place of occurrence and had been arrested, have since been granted the privilege of regular bail in Cr. Misc. No. 44575 of 2017 vide order dated 16.10.2017.

In view of such fact and circumstances and that the petitioner has a clean antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Saharsa, in connection with Bangaon P.S. Case No.32/2017.
