14-09-2016 Heard Sri Ajay Kumar Sharma, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Parsa P.S. Case No. 47 of 2016 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code, has prayed for grant of bail in the event of arrest or surrender.
By way of referring to Annexure - 2 to the present petition, it was submitted by learned counsel for the petitioner that from petitioner's side, an F.I.R., vide Parsa P.S. Case No. 46 of 2016, was lodged on 16-03-2016 against the informant of the present case for offence under Section 307 & other allied sections of the Indian Penal Code and Section 3(1)(x) of the Scheduled
Patna High Court Cr.Misc. No.38137 of 2016 (2) dt.14-09-2016 2/2 Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short "SC/ST Act") and after two days, the present F.I.R. was lodged on 18-03-2016 by one of the main accused of Parsa P.S. Case No. 46 of 2016. He further submits that during medical examination, the doctor has found injuries simple in nature. He further submits that allegation levelled under Section 379 of the Indian Penal Code is only exaggeration.
Keeping in view the nature of accusation and the fact that there was case and counter case in between the parties, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Gajendra Manjhi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K.Yadav, learned Judicial Magistrate, Saran at Chapra in connection with Parsa P.S. Case No. 47 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
