The petitioner who is in custody since 22.02.2018 has filed the instant application for grant of bail in connection with Minapur P.S. Case No. 68 of 2018 registered for the offence punishable under sections 414 and 34 of the Indian Penal Code and sections 25(1-b)A, 26 and 35 of the Arms Act. As per the allegation in the FIR, a loaded country made pistol, cartridges and other articles were recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the allegations leveled in the F.I.R. are false and concocted and the petitioner is in custody since 22.2.2018.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner is in custody since 22.2.2018, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 13th, Muzaffarpur in connection with Minapur P.S. Case No. 68 of 2018.

It is directed that the petitioner shall remain present on each and every date in the court below in course of trial. In case of absence of the petitioner on two consecutive dates for the reasons not to the satisfaction of the trial court the bail of the petitioner shall be cancelled and he shall be taken into custody till conclusion of the trial.
